Objetiva avaliar em que medida as legislações educacionais contemplam o direito do cidadão a esse nível de educação. Uma vez que, no Estado Democrático de Direito é basilar a dignidade da pessoa humana que se coaduna à proteção jurídica de direitos fundamentais, o tema atrelase, respectivamente, ao desenvolvimento humano e à justiça social. A metodologia aplicada neste estudo está baseada em levantamento e estudo da bibliografia pertinente ao assunto e explora dados oficiais e documentais sobre a educação superior no país, abrangendo a era Colonial, Imperial e o Período Republicano até os dias atuais, abordando a educação superior e, no interior desta, a superior jurídica. Sob a visão de que a educação influencia a conduta humana em sociedade, a problemática reside em quem foi por ela beneficiado, ou quem teve a ela acesso, enquanto direitos relativos à educação superior; se as políticas públicas atuam como mecanismos de acesso, em busca da verdadeira democracia social; e, por fim, qual o papel que a questão da evasão na educação superior desempenha neste cenário. Como resultado desse estudo, destaca-se o processo de democratização da educação superior.This research highlights higher education in Brazil, seen as a right or privilege of the citizen, focused on the professional of law. It aims at educational legislation and the extent to which it contemplates the right of the citizen to this level of education. Since, in the Democratic State of Law the dignity of the human being, which is in line with the legal protection of fundamental rights, is considered essential, this subject is linked respectively to human development and social justice. The methodology applied in this study is based on the research and study of the relevant bibliography and explores official and documentary data on higher education in the country, covering the Colonial and Imperial times, as well as the Republican Period, up to the present day, addressing higher education and, inside it, the higher legal education. Under the perspective that education influences human behavior in the society, the problem lies in who was benefited from it, or who had access to it, as rights related to higher education; whether public policies act as mechanisms of access, in search of true social democracy; and finally, the role played by the evasion in higher education in this process.
