A pesquisa do tema se justifica pelo interesse em mostrar como ocorre a judicialização, que obrigou a Secretaria Municipal da Educação (Sedu), a um estudo minucioso e a uma engenharia administrativa para atender a essas ordens judiciais, de modo a garantir as vagas e o funcionamento das escolas de Educação Infantil do município. Faz uma abordagem sobre os seguintes problemas: como a política educacional do município se adaptou ao processo de demanda por vagas via judicialização? Trabalha com a hipótese de que é preciso ressaltar que a interferência do judiciário ao garantir o acesso à vaga na creche e resolver o problema da família, pode acarretar problemas para os setores administrativos e funcionais, principalmente para as instituições educacionais. Possui como objetivo principal apresentar quais os efeitos para a política municipal de educação infantil, gerados pela interação entre o sistema de justiça e a Secretaria Municipal de Educação. Como objetivos específicos, faz ainda uma abordagem se as famílias que cumprem os trâmites administrativos são prejudicadas com esse processo de judicialização; aborda se o direito pedagógico da criança está sendo atendido. Como referências traz Callegari (2017), Marinho (2009), Kramer (2007), Kuhlmann Jr.(2002), Kishimoto (1986) com a consideração de alguns temas que discorrem sobre o assunto, a história do surgimento da creche, objetivos e as diretrizes curriculares para Educação Infantil. Livros, periódicos e artigos que abordam o assunto embasam as reflexões da temática. Também ao tratar mais especificamente sobre o município de Sorocaba/SP, são utilizados documentos, estatísticas levantadas pela Secretaria de Educação e outras informações importantes fundamentais para mostrar o trabalho efetivo diante dos efeitos na política municipal de educação infantil gerados pela interferência do judiciário no acesso a essas vagas.This dissertation addresses the lack of vacancies in day care centers, and deals more specifically with the judicialization process and the municipal policy of Early Childhood Education in the city of Sorocaba/SP. And as specific objectives, it makes an approach if the families that comply with the administrative procedures are harmed by this judicialization process; discusses whether in the midst of so many transfers, the child's pedagogical right is being met. Through bibliographical research, Callegari(2017), Marinho(2009), Kramer (2007), Kuhlmann Jr.(2002), Kishimoto (1986) it makes an approach on some themes that discuss the subject, such as: the history of the emergence of the day care center, the legal support for the right to day care places, the curriculum guidelines for Early Childhood Education on the subject, and thus they are used books, periodicals, articles that address the subject.
