O que antes era considerado por muitas boas práticas, agora passará a ser obrigação. A nova legislação tem como objetivo proteger a privacidade e o interesse do indivíduo em sua liberdade. As obrigações impostas por essa Lei (13.709/2018), geram um impacto maior ainda na área da saúde, pois estamos tratando de dados considerados sensíveis, que devem ser tratados com muita responsabilidade e segurança por parte das empresas privadas e públicas e em geral na saúde. Nos ambientes hospitalares, clínicas e atendimentos médicos, o foco principal deveria ser o de fazer a melhor adequação possível aos termos da lei, na tentativa de minimizar ou até mesmo sanar os erros e inseguranças que geram com o mau uso da tecnologia. Aqueles nesse mercado que conseguirem demonstrar uma maior preocupação quanto à proteção de seus dados e garantir transparência e legalidade a seus clientes, com certeza serão beneficiados com esse diferencial.Purpose of this research is to deal with the new legislation (LGPD) that provides for the processing of personal data, by natural person. What was once considered good practice will now become an obligation. The new legislation aims to protect the individual's privacy and interest in his freedom. The obligations imposed by this Law (13.709/2018), that generate an even greater impact in the area of health, as we are dealing with data considered sensitive, which must be treated with great responsibility and security by private and public companies and in general in health. In hospital environments, clinics and medical care, the main focus should be on making the best possible adaptation to the terms of the Law, in an attempt to minimize or even remedy the errors and insecurities generated by the misuse of technology.
