Para isso, serão apresentados conceitos sobre o tema, a busca pela "verdade real" e a prova testemunhal no processo penal. Ao analisar os aspectos jurídicos e a implicação das falsas memórias, fica evidente a fragilidade dessa prova, uma vez que depende exclusivamente da memória das testemunhas, o que a torna crucial para a decisão do juiz. Para compreender a importância da memória humana no processo penal, é necessário realizar um estudo interdisciplinar. Neste estudo, foram utilizadas análises bibliográficas e documentais para entender as falsas memórias e seu impacto na prova testemunhal, que muitas vezes é a única evidência disponível. Também foram analisados os fatores que podem contaminar a prova testemunhal e as técnicas que podem ser usadas para minimizar danos, como a Entrevista Cognitiva e o Reconhecimento Pessoal Sequencial.The present study aims to analyze the implication of false memories in the reconstruction of facts by witnesses in criminal proceedings and the possible reduction of consequent damages. To this end, concepts will be presented on the topic, the search for the "real truth" and testimonial evidence in criminal proceedings. When analyzing the legal aspects and the implication of false memories, the fragility of this evidence becomes evident, as it depends exclusively on the memory of witnesses, which makes it crucial for the judge's decision. To understand the importance of human memory in the criminal process, it is necessary to carry out an interdisciplinary study. In this study, bibliographic and documentary analyzes were used to understand false memories and their impact on testimonial evidence, which is often the only evidence available.
