Primeiramente, foi abordada a evolução no conceito de família no direito brasileiro que não se enquadra mais somente na união matrimonial e seus descendentes, mas também na relação de afeto e cuidado. Verifica-se que o princípio da afetividade define o afeto como importante fator das relações familiares e não apenas o vínculo biológico, sendo reconhecido pelo ordenamento jurídico e pela jurisprudência. Assim, essa pesquisa possui a finalidade de demonstrar os requisitos para o reconhecimento na esfera extrajudicial, além da importância do afeto e do cuidado e as consequências que podem gerar na vida do(a) filho(a) que vier a ser reconhecido(a).This research deals with socio-affective affiliation and aims to analyze the issues that involve such affiliation in the extrajudicial scope, as well as to point out the requirements for recognition and the impossibility of its deconstitution in this way. First, the evolution of the concept of family in Brazilian law was addressed, which no longer fits only in the marriage union and its descendants, but also in the relationship of affection and care. It appears that the principle of affectivity defines affection as an important factor in family relationships and not just the biological bond, being recognized by the legal system and jurisprudence.
