O objetivo é demonstrar que a saúde é um direito fundamental de todo ser humano e que sua efetividade é imprescindível, e o sistema prisional deve garantir a proteção desse direito para os detentos. Entretanto, as condições de saúde no sistema penal são precárias e muitas vezes insuficientes. Nesse contexto, o trabalho mostrará com o estudo do tema, que apesar de alguns direitos serem retirados do indivíduo que cumpre pena, eles continuam possuindo os direitos da pessoa humana e de cidadãos, além de todos os direitos sociais que lhe são inerentes, e estes, devem ser assegurados pelo Estado, incluindo aqueles relacionados à saúde.This scientific article intends to analyze the theme referring to the effectiveness of the right to health in the context of the prison system in Brazil through bibliographical research. The objective is to demonstrate that health is a fundamental right of every human being and that its effectiveness is essential, and the prison system must guarantee the protection of this right for detainees. However, health conditions in the prison system are precarious and often insufficient.
