| dc.description.abstract | Neste trabalho, será exposto as circunstâncias que prevalecem ao requerer a “Pensão Por Morte” (tratando-se do Regime Geral da Previdência Social), e quais dificuldades esses segurados se deparam, a fim de obter a concessão do referido benefício previdenciário. Desta forma, será apresentada a análise da controvérsia legislativa diante a falta de dispositivos legais que amparam as situações sociais, bem como, dispõe sobre a evolução histórica e os princípios que norteiam a Pensão Por Morte. Desta maneira, com o advento da sociedade, e todas as questões intrínsecas ao desenvolvimento humano e as suas formas de relacionamento, é de suma importância preservar e adequar o princípio da Igualdade, de maneira pelo qual o entendimento de separação, seja esta de fato ou judicial, seja tratado com equivalência. Diante da realidade, o presente artigo exibe a análise, principalmente das jurisprudências atuais, artigos científicos e doutrinas que esclareçam e nos enfatizam informações pertinentes ao caso. Inclusive, verificando as diversas lacunas jurídicas diante ao tema, nota-se a relevância da complementação destas por meio de analogia. Portanto, neste momento, se torna imprescindível o aprofundamento dos entendimentos jurisprudenciais. E, havendo êxito em constatar a “necessidade econômica superveniente”, a benesse em questão, deverá amparar o segurado que o pleiteia, conforme dispõe a Súmula 336 do Superior Tribunal de Justiça. | pt |
| dc.description.abstract | In this work, the circumstances that prevail when requesting the “Pensão por Morte” (in the case of the General Social Security System) will be exposed, and what difficulties these insured people face, in order to obtain the concession of the referred social security benefit. In this way, the analysis of the legislative controversy will be presented in the face of the lack of legal provisions that support social situations, as well as, it deals with the historical evolution and the principles that guide the Pension for Death. In this vein, with the advent of society, and all issues intrinsic to human development and its forms of relationship, it is of paramount importance to preserve and adjust the principle of Equality, so that the understanding of separation, whether in fact or court, be treated with equivalence. Faced with reality, this article displays the analysis, mainly of current jurisprudence, scientific articles and doctrines that clarify and emphasize information relevant to the case. Including, verifying the various legal gaps on the subject, it is noted the relevance of complementing them by means of analogy. Therefore, at this moment, it becomes essential to deepen the jurisprudential understandings. And, if there is success in verifying the “supervening economic need”, the benefit in question, must support the insured person who claims it, as provided for in Precedent 336 of the Superior Court of Justice. | en |
